Florida is a lien-theory state, so seller-financed transactions are secured by a standard mortgage โ not a deed of trust. If a note ever goes into default, Florida requires judicial foreclosure through the court system (Fla. Stat. Ch. 702), and the process typically takes 8 to 14 months for an uncontested case, with the final judgment sale set 20 to 35 days out under Fla. Stat. ยง 45.031. Contested cases or backlogged counties like Miami-Dade and Broward can stretch well beyond a year.
Anti-Deficiency Protection
Florida offers only limited anti-deficiency protection. Under Fla. Stat. ยง 702.06, a deficiency judgment on owner-occupied residential property is capped at the difference between the outstanding debt and the property's fair market value at the time of sale โ but deficiency judgments themselves are generally still permitted. Purchase-money mortgages receive some added scrutiny, but there is no blanket prohibition on deficiencies as in states like California or Washington.

Recording Fees & Transfer Taxes
Florida charges a documentary stamp tax of $0.35 per $100 of indebtedness on new promissory notes under Fla. Stat. ยง 201.08. Assigning an existing note or mortgage generally does not trigger additional doc stamps since no new indebtedness is created, but recording the assignment still requires standard county fees โ roughly $10 for the first page and $8.50 for each additional page. Note that the underlying mortgage may also have been subject to Florida's separate 0.2% intangible tax under Fla. Stat. Ch. 199 at origination.
